By downloading, installing, or using the Fluentko mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Fyrosoft Technologies Private Limited (“Company,” “we,” “us,” or “our”).

2. Description of Service

Fluentko is an AI-powered English language learning application that provides:

  • AI-powered conversation practice
  • Pronunciation analysis and feedback
  • Structured learning lessons
  • Progress tracking and analytics

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.

4. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Upload malicious content or software
  • Violate the rights of other users
  • Use the App to harass, abuse, or harm others
  • Reverse engineer, decompile, or disassemble any part of the App

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, audio, software, and AI models, are owned by Fyrosoft Technologies and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Subscriptions and Payments

6.1 Free and Paid Services

The App offers both free and premium subscription features. Premium features require a paid subscription.

6.2 Billing

Subscription fees are billed through your app store account (Apple App Store or Google Play Store) according to their terms and conditions.

6.3 Refunds

Refund requests are handled according to the policies of your respective app store. Please contact Apple or Google for refund inquiries.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYROSOFT TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

9. Indemnification

You agree to indemnify and hold harmless Fyrosoft Technologies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
